They are kept for the duration of the business relationship and then for 3 years after the last contact; accounting records are kept for 10 years. General terms and conditions of sale

1. Purpose and scope

These terms govern distance sales concluded on the website between DEMO (the “seller”) and any natural person buying for personal purposes (the “customer”). Placing an order implies acceptance of the terms in force on the day of the order, which the customer can save and print.

2. Products and availability

The essential characteristics of the products are shown on their page; photographs are as faithful as possible but are not contractual. Offers are valid while they are displayed on the website and while stocks last. If an ordered product proves unavailable, the customer is informed as soon as possible and refunded within 14 days of payment at the latest, unless they accept an equivalent product.

3. Prices

Prices are in euros, all taxes included. Delivery and, where applicable, handling costs are shown before the order is confirmed. Products are invoiced at the price displayed when the order is confirmed.

4. Orders

The customer selects products, checks the content and total price of the basket, chooses delivery and payment methods, can correct any errors, then confirms the order; this final click is an order with an obligation to pay. A summary e-mail confirms the order. The contract is concluded in French; its details remain available in the customer account. The seller may refuse an order in the event of an unresolved previous dispute or for a legitimate reason (suspected fraud, abnormal order).

5. Payment

Payment is due when ordering, using the methods offered on the website. Card payments are processed by secure providers: the seller does not keep any bank details. To prevent fraud, proof of identity or address may be requested; the order is then processed upon receipt of that proof.

6. Delivery

Products are delivered to the address given by the customer, within the time stated when ordering or, failing that, within 30 days at most. In case of delay, the customer may, after a formal notice that has gone unheeded, cancel the sale and be refunded (articles L216-6 et seq. of the French Consumer Code). Risk passes to the customer when they take physical possession of the products. If a parcel is damaged or incomplete, the customer reports it to the carrier and informs the seller as soon as possible; this helps handling but does not deprive the customer of any rights.

7. Right of withdrawal

The customer has a period of 14 days from receipt of the products to withdraw, without giving any reason or paying any penalty (article L221-18 of the French Consumer Code). For an order delivered in several parts, the period runs from receipt of the last product.

The customer notifies the decision by an unequivocal statement, by e-mail to demo@123ventes.com or using the form below, then returns the products no later than 14 days after that notification. Return costs are borne by the customer unless otherwise stated on the product page. The customer is only liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

The seller refunds all sums paid, including standard delivery costs, no later than 14 days after being informed of the withdrawal, using the same means of payment unless the customer agrees otherwise. The refund may be withheld until the products have been received back or proof of their dispatch has been supplied.

The right of withdrawal does not apply in particular (article L221-28) to: goods made to the customer's specifications or clearly personalised; goods liable to deteriorate or expire rapidly, such as food; sealed goods unsealed after delivery that cannot be returned for health protection or hygiene reasons; sealed audio or video recordings or software unsealed after delivery.

8. Legal guarantees

The seller is liable for any lack of conformity existing at delivery, under articles L217-3 et seq. of the French Consumer Code. The customer has 2 years from delivery to act; during that period they do not have to prove that the defect already existed (12 months for second-hand goods). They may obtain repair or replacement free of charge or, failing that, a price reduction or cancellation of the sale. The customer also benefits from the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code) for 2 years from discovery of the defect. These guarantees apply regardless of any commercial guarantee.

9. Liability

The seller is not liable for non-performance caused by the customer, by the unforeseeable and insurmountable act of a third party or by force majeure (article 1218 of the French Civil Code). These limits in no way reduce the customer's legal guarantees.

10. Customer service and complaints

For any question or complaint: demo@123ventes.com, on to be completed, or through the form on the Contact page.

11. Mediation

If a dispute cannot be resolved in writing with customer service, the customer may refer it free of charge to a consumer mediator (articles L612-1 et seq. of the French Consumer Code): to be completed.

12. Applicable law

These terms are governed by French law. Failing an amicable settlement, the dispute is brought before the competent courts under ordinary rules; the customer may choose the court of the place where they lived when the contract was concluded.
